Properties sold under the Right To Buy
As from 10th August 2005, any property sold under the Right to Buy Scheme - The
leaseholder / freeholder is bounded by the covenant - The Right to First Refusal under Section 156A of the Housing Act 1985.
If the leaseholder / freeholder wishes to sell their property within ten years after the property is transferred to them, they must first offer the property for purchases back to the former landlord (
Brent Council), its successor (if the property has been transferred to a another housing authority), or a person nominated by the former landlord.
The leaseholder / freeholder selling their property must serve a notice upon Brent Council. The council then has 8 weeks to inform the leaseholder / freeholder whether they accept or reject the offer of purchasing their property.
